Terms of Service

By signing up for or using the Service, you agree to the Terms and Conditions, and acknowledge that you have read and understand the conditions of use and agree to abide by them.

The Terms of Service (here) along with the Privacy Policy, the Terms of Use, and the Refund Policy together and jointly make up the "Terms and Conditions" referenced throughout the site.

1. Pro Access

1.1 Trials - Each user account library may receive one trial per product offered, in the lifetime of the account. Upon commencing a trial, your trial period will be such as is offered at time of signing up for trial. Limitations of use in hourly, daily, and weekly, exists in the trial, and will not be adjusted. To remove/adjust limits you may engage in a paid version of the subscription prior to the end of the trial. Your credit card will be charged at a pro-rata rate for the number of days used from the trial, not the days offered of the trial. The trial length is the maximum length offered as a trial and surrender of the trial prior to the termination of the trial does not grant any value or credit to the account. Additionally, the trial may not be restarted for the days not used of the trial offering. Termination of the trial will cause immediate removal of trial songs from your My Library. See further termination terms in below in section 1.5.

1.2 Payment Terms - Your subscription involves a recurring payment of a fee, which may change at any time without notice, and unless you cancel your subscription one (1) day before your billing date in your online account OR notify us three (3) business days before your billing date that you want to cancel or do not want to automatically renew your subscription, you understand it will automatically continue and you authorize us, without notice to you (unless required by applicable law), to collect the then-applicable fees and any taxes, using the payment type selected for the subscription. PraiseCharts is not responsible or liable for ensuring that your credit card is valid and unexpired, though we will do our best to notify you if such is the case. We are not responsible or liable if your subscription expires due to us not being able to complete the recurring charge for your subscription. If the primary payment method we have on file for you is declined for payment of your subscription fees, we may cancel your subscription, unless you provide us with a new credit card. If you provide us with a new credit card and are successfully charged before your subscription is canceled, your next subscription charge will be based on the original renewal date and not the date of the successful charge.

1.3 Restrictions and Abuse Limits - Some songs or resources from the onsite catalog may not be included in the Pro Access plans, and PraiseCharts reserves the right to add or remove content at any time without notice. Music accessed through a Pro plan is nontransferable, and is subject to all copyright law, including copying.

PraiseCharts reserves the right to monitor your usage of the service and to take appropriate action if PraiseCharts detects any abuse or misuse of the service. This may include, but is not limited to, limiting, restricting, or suspending your access to the service at any time. The limitations that exist in the trials are separate from the limitations that exist in the paid subscription. Download/access abuse limits and/or warnings are in place for hourly, daily, weekly, monthly and yearly access. There is a firm limitation of 200 songs per resource plan, per year, in the paid subscription. These limits only serve to protect the music from abuse-case scenarios. If you have reached a limit, please reach out to support@praisecharts.com or 1-800-695-6293 to discuss having the limit adjusted or removed. 

It is the subscriber's responsibility to keep track of the number of song access/downloads throughout the year. PraiseCharts does provide a use count as a convenience, but is not liable to the customer for the accuracy of that count, and as such it may be adjusted to true count if a periodic review reveals a mis-reported count occurred. With continuous Pro Access membership from year to year, PraiseCharts may offer to store, at its own discretion, past year's Pro Accessed songs, gratis or at cost, for members who maintain a CCLI license. 

1.4 Refunds and Cancellation - Annual subscriptions have 14 days after each billing cycle to cancel and receive an adjusted refund (based on resources used/accessed), while monthly subscriptions have 5 days after each billing cycle to cancel and receive an adjusted refund. If requesting a Pro Access refund, your access to those charts will be rescinded and removed from your My Library immediately upon cancellation. You must contact support@praisecharts.com within the refund window to request a refund.

For cancellations without request of refund, the subscription will continue through the paid term and then will terminate, at which time access to the relevant resources will be rescinded and products removed from your My Library.

There are no returns or exchanges of music under a Pro Acess subscription.

1.5 Termination of Subscription - Termination of a Pro Access Trial prior to paying for the subscription will cause your access to those charts to be immediately rescinded and removed from your My Library. Within a paid subscription, you can cancel your subscription according to the terms listed here and in 1.2. When you terminate your subscription, the applicable song products will remain in your account for the duration of the paid term, at which point the song products will be removed from your My Library and access to those song products through PraiseCharts will be rescinded. 

2. Credit Bundles

2.1. Bundle Options - As part of a discount offer, savings offers, or promotion, you may purchase or we may issue you credits redeemable for content on www.praisecharts.com ("Credits"). Credits may only be redeemed on praisecharts.com, and are non-transferable. All Credits are valid for a limited time (purchased Credits are valid for twelve (12) months unless canceled; promotional Credits are valid for 30 days.) Credits expire immediately upon the cancellation or termination of your Bundle unless used prior to cancellation or termination.

2.2. Payment terms - The fees for Credit Bundles may change at any time without notice. Payment/Fees may be subject to tax.

2.3. Restrictions on use - You cannot use Gold Credits to purchase orchestrations.  With your Gold Credits, you can purchase Lead Sheets and Audio Tracks (etc.), but you will have to use a standard payment method to purchase an orchestration. Credits are used as First-In-First-Out, with refunded credits always being the first used.

2.4. Refunds and Returns - If you purchased a Bundle of Credits, and have since decided you do not need or want all of this great music from PraiseCharts, we do offer a refund option with the following condition: you must pay full price for any charts that you had downloaded with your credits. Your refund will be calculated to be the purchase price of the bundle less the full retail value of the products purchased with the spent credits. If you have downloaded a chart and prior to public performance decide the song does not meet your needs, we will be glad to refund your purchase. Refunded credits are placed back in your Credit Summary and are the first used as you continue to spend your credits.

2.5. Termination of Credits - Credit Bundles expire 12 months from the purchase of that bundle. Approximately one (1) month before your credits are set to expire, we send out credit expiration reminder emails. As long as you renew with a new Credit Bundle or Subscription before the current bundle expires, your current credits will roll over for an additional six (6) months. Termination of Credit Bundles does not terminate your access to purchased charts.

3. Credit Subscriptions

3.1. Subscription Options - As part of discount savings, you may purchase or we may issue you credits redeemable for content only on www.praisecharts.com ("Credits"). Credits may only be redeemed on praisecharts.com, and are non-transferable. All Credits are valid for a limited time (purchased Credits are valid for twelve (12) months unless canceled/terminated; promotional Credits are valid for 30 days.) Credits expire thirty (30) days (or on their set expiry date, if less) after the cancellation or termination of your Subscription unless used prior to cancellation or termination.

3.2. 3.3. Restrictions on use - You cannot use Gold Credits to purchase orchestrations.  With your Gold Credits, you can purchase Lead Sheets and Audio Tracks (etc.), but you will have to use a standard payment method to purchase an orchestration. Credits are used as First-In-First-Out, with refunded credits always being the first used. Monthly Subscription Credits, Top-Up Credits, or promotional credits cannot be extended or rolled over.

3.4. Refunds and Returns - Members who purchase monthly auto-renewing subscriptions have 5 days after each billing cycle to cancel and receive a refund. The refund will be calculated as 1) if no credits have been used from the new month's Credit set, that current month's full charge will be refunded and the correlating Credit set will be removed; 2) if credits have been used from the new month's Credit set, that current month's charge will be refunded less the full retail value of the products purchased with the spent credits. In either case, the 30-day expiration on unused, unexpired credits will be calculated from one day before the billing date (no credits will be extended past their set expiry date). If you have downloaded a chart and prior to public performance decide the song does not meet your needs, we will be glad to refund your purchase. Refunded credits are placed back in your Credit Summary and are the first used as you continue to spend your credits.

3.5. Termination of Subscription - You may cancel your subscription at any time by visiting your Subscriptions page. Upon cancellation by you or termination by non-payment, all credits are set to expire thirty (30) days from the day of cancellation/termination (or their set expiry date, if less). You may reactivate your subscription within thirty (30) days after the initial cancellation/termination by making up the missed billing cycle. Upon successful completion of the missed payment, your original subscription schedule will resume and any unused, unexpired credits will be restored with their original expiry date. Cancellation and reactivation can be managed in your Subscriptions.

4. Credit Top-Ups

4.1. Top-Up Options - Top-Up Credits are available to monthly subscription customers only, at the same increment level as their current subscription.

4.2. Payment terms - Top-Up Credits are a one time purchase using the payment method of your choice. The cost of Credit Top-Ups may change at any time. Payment/Fees may be subject to tax.

4.3. Restrictions on use - Top-Up Credits spending order occurs after any prior months and current month's credits, and before the month following the purchase of the Top-Up credits. You cannot use Gold Top-Up Credits to purchase orchestrations. Credits are used as First-In-First-Out, with refunded credits always being the first used. Top-Up Credits cannot be extended or rolled over.

4.4. Refunds and Returns - Credit Top-Up packages may be refunded within 30 days providing the all the credits in the package are unused (an 'unopened' Top-Up) and providing the subscription is active and in good standing. Refunds are not available if the subscription has been canceled (even if it is in the 30 day expiry period) or if it is in an unpaid state. If you have downloaded a chart and prior to public performance decide the song does not meet your needs, we will be glad to refund your purchase. Refunded credits are placed back in your Credit Summary and are the first used as you continue to spend your credits. (Note that a Top-Up package that has spent credits that have been refunded back does not constitute an 'unopened' package.)

4.5. Termination of Top-Ups - If you cancel your subscription or your subscription is terminated for non-payment (eg expired credit card), your Top-Up Credits will expire after 30 days (or their set expiry date, if less).

6. Additional Terms For All Pro Subscriptions

6.1 Subscription Renewal: Subscriptions will automatically renew and incur recurring fees at the then-current subscription rate plus applicable tax, unless canceled in your online account one (1) full day before the billing date or by calling or emailing us three (3) business days before the billing date. No notice of rate change will be required.
6.2 Payment Terms: PraiseCharts will automatically collect subscription fees using your selected payment method. If your primary payment method is declined, PraiseCharts may cancel your subscription unless a new valid credit card is provided. If your subscription is cancelled due to non-payment, you can restart your subscription online by completing payment.
6.3 Subscription Termination: You can cancel your subscription at any time via your Subscriptions page. All credits expire thirty (30) days from the day of cancellation or termination. Reactivate your subscription within thirty (30) days after cancellation/termination by making up the missed billing cycle to restore unused, unexpired credits and resume your original subscription schedule.
6.4 Disclaimer: Website access and Pro Subscription access is provided on an "as is" and "as available" basis. PraiseCharts makes no warranties or representations regarding the quality, accuracy, or completeness of the content provided through the site or service. Additionally, PraiseCharts cannot guarantee that the access will be uninterrupted or error-free, and PraiseCharts is not liable for any damages arising from your use of or (in)ability to access the service.

7. General Terms

7.1 Music acquired from PraiseCharts is non-transferable and cannot be shared with other churches. If you move to another church, you cannot take your music with you. Rather, you should create a new PraiseCharts account, and then purchase any music your require for that new location. Sharing of account information is expressly prohibited. Only one person is allowed to access an account login.

7.2 Agreement Changes - We may, in our discretion, change the Terms and any and all elements of them and any aspect of the Service, without notice to you. If any change to the Terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes and the remainder of the Terms. Your continued use of the Service after we change the Terms constitutes your acceptance of the changes. If you do not agree to any changes, you must not use the Service and must cancel your Credits and/or Subscription.

7.3 Modification and Interruption - We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Site (though it is always with the purpose to make it better for you!). We also reserve the right to modify or discontinue all or part of the Site without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site in whole or part.

Much to our chagrin, we cannot guarantee the Site will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Site, resulting in interruptions, delays, or errors. For this we apologize for any inconvenience; please know it is never our desire to cause a disruption. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Site at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Site during any downtime or discontinuance of the Site. Nothing in these Terms of Use will be construed to obligate us to maintain and support the Site or to supply any corrections, updates, or releases in connection therewith.

7.4 Termination by Us - Our business may change over time and we reserve the right to cancel the Service and any Credit or Subscription plan in whole or in part and to terminate your access and use of the Service at our discretion without notice. If we do so, we will give you a prorated refund based on the value remaining in your account unless we terminate your membership for conduct that we determine, in our discretion, violates the Terms or, violates any applicable law, involves fraud or misuse of the Service, or is harmful to our interests or another user, or is generally in bad faith or against Christian and biblical ethics. Our failure to insist upon or enforce strict compliance with the Terms will not constitute a waiver of any of our rights.

7.5 Disputes - In the event of a dispute under this Agreement, the parties may choose to mediate using the services of a pastoral or Christian mediator. In the event, the parties do not mediate or mediation is unsuccessful or unavailable, the parties agree to submit their dispute to final and binding arbitration before an arbitrator in accordance with the Rules of Procedure for Christian Conciliation as established by the Institute for Christian Conciliation (a division of Peacemaker Ministries). Any arbitration hearings will be held in Langley, BC, Canada. Judgment upon any award rendered in arbitration may be entered in any court having jurisdiction thereof.
